Terms & Conditions

1. Scope of Work

The Company agrees to perform the Services as outlined in the written proposal or estimate provided to the Client. Any additional work or modifications must be agreed upon in writing by both parties.

2. Estimates and Proposals

All estimates and proposals are valid for 30 days from the date issued unless otherwise specified. Acceptance of a proposal must be communicated in writing. The Company reserves the right to withdraw or modify any proposal prior to acceptance.

3. Scheduling and Access

The Client agrees to provide the Company with reasonable access to the property during normal business hours to perform the Services. The Company will make reasonable efforts to adhere to scheduled dates but is not liable for delays due to weather, supply shortages, or other unforeseen circumstances.

4. Payment Terms

Payment terms will be specified in the proposal. Unless otherwise agreed, a deposit may be required prior to commencement of work, with the balance due upon completion. Late payments may be subject to interest charges as permitted by law.

5. Changes and Additional Work

Any changes to the scope of work must be documented in a written change order signed by both parties. Additional charges may apply for changes or unforeseen conditions not included in the original proposal.

6. Client Responsibilities

The Client is responsible for:

  • Ensuring that the property is accessible for the Company to perform the Services.

  • Removing or protecting personal property in and around the work area.

  • Notifying the Company of any known hazards or conditions that may affect the work.

7. Warranties

The Company warrants that all work will be performed in a professional and workmanlike manner. Specific warranty terms, including duration and coverage, will be provided in the proposal or upon request. Manufacturer warranties on materials are subject to their respective terms and conditions.

8. Insurance and Liability

The Company maintains appropriate insurance coverage, including general liability and workers' compensation. The Client agrees to indemnify and hold harmless the Company from any claims arising from the Client's negligence or failure to fulfill responsibilities outlined in this Agreement.

9. Termination

Either party may terminate this Agreement with written notice if the other party breaches any material term and fails to cure such breach within a reasonable period. Upon termination, the Client agrees to pay for all Services rendered and materials purchased up to the termination date.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Services are performed, without regard to its conflict of law principles.

11. Dispute Resolution

Any disputes arising under this Agreement shall first be attempted to be resolved through good faith negotiations between the parties. If unresolved, disputes may be submitted to mediation or arbitration as agreed upon by both parties.

12. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, or understandings, whether written or oral.
